SHIMA HELPCENTER TERMS OF USE FOR USERS

SHIMA HelpCenter Terms of Use for Users (these “Terms”) set forth the terms of use, etc. of SHIMA HelpCenter service (the “Service”) provided by SHIMA SEIKI MFG., LTD. (“Shima Seiki”). A User is required to agree to comply with the provisions of these Terms in addition to the SHIMA SEIKI Online Services Terms of Use for Users (“SHIMA online Terms of Use”)((https://online-services.shimaseiki.com/terms/en).) These Terms are related to the SHIMA online Terms of Use. Please refer to the definitions of the certain terms of these Terms.

Article 1. Purpose of these Terms

  1. These Terms set which Shima Seiki, the User Applicant and a Registered User shall comply with in using the Service provided by Shima Seiki.
  2. The Registered User shall comply with these Terms in addition to the SHIMA online Terms of Use. If there is any inconsistency with respect to the same matter between these Terms and the said relevant regulations and rules for use, these Terms shall prevail.

Article 2. Definitions

The following terms used herein shall have the meanings as defined below:

  1. “Digital Contents” is a term collectively referring to all "Help", "FAQ", "Manuals", and "Glossary" which are provided through the Service.

Article 3. User Authorization and the Content of the Service

  1. The purpose of this Service is to search and view Digital Contents in an online environment, including specifications, setup and usage of Shima Seiki products themselves (there are exceptions.) and the accessories included with the products (excluding consumables, software and other items that do not qualify as Shima Seiki’s products.).
  2. The Guest User may search and view "Glossary" among digital contents.
  3. The System User and the Knit User may search, view, and use pursuant to the provisions of these Terms, all the Digital Contents.

Article 4 Digital Contents

  1. The Digital Contents refer to general usage and basic functions of Shima Seiki products and is not an exhaustive list of information.
  2. The Digital Contents is subject to change without notice due to changes in specifications of Shima Seiki products.
  3. The safety precautions included in Digital Contents are in line with legal and industry standards at the time of creation of Digital Contents.
  4. The contents of the instruction manual included in the Digital Contents may differ from the contents of the instruction manual that came with the purchase of Shima Seiki products. Please use the instruction manual in the Digital Contents as supplemental information to the instruction manual that actually came with Shima Seiki product at the time of purchase.
  5. Precautions and other information about Shima Seiki products that are not included in Digital Contents may be included in printed materials or attached to the package of Shima Seiki products. When using Shima Seiki products, please also check these precautions.
  6. If you do not find the information you want in the Digital Contents, contact Shima Seiki or your local dealer of Shima Seiki products directly. However, please note that we may not be able to provide instruction manuals or other information for the product due to reasons such as the discontinuation of production of the product itself.

Article 5. User Fee

The user registration for the Service and searching and viewing of the Digital Contents through the Service shall be free of charge.

Article 6. Privacy Policy

The Privacy Policy regarding personal information acquired by Shima Seiki from the User Applicant or the Registered User in relation to the Service is posted on the following webpage.

Article 7. Cookie Policy

The Service keeps data called cookies which are necessary to provide the Service or increase the Registered User’s ease of use. For more details, please visit https://helpcenter.shimaseiki.com/en/cookie_policy/

Article 8. Intellectual Property Rights, etc.

Copyrights, any and all other intellectual property rights, and other rights of or in the Digital Contents which is viewed, searched or used by the Registered User through the Service shall belong to Shima Seiki.

Article 9. Prohibited Acts

The Registered User, its related persons/parties, any third party instructed by the Registered User, and any other persons/parties similar thereto shall be prohibited from committing any act falling under any of the following items. If it is determined that any such act has been committed, Shima Seiki may take measures to suspend the use under SHIMA online Terms of Use Article 10 (Suspension of Use and the Deletion of the User Registration), and claim for damages under SHIMA online Terms of Use Article 11 (Compensation for Damages) from the relevant Registered User at the discretion of Shima Seiki.

  1. Selling, transferring (paid or free), lending, pawning, collateralizing, licensing or otherwise disposing of Digital Contents data and copies thereof to third parties without Shima Seiki’s prior written permission, or storing, reproducing or disclosing Digital Contents data to third parties for the purpose of these acts without Shima Seiki’s prior written permission.
  2. Use of Digital Contents for purposes other than inquiring about Shima Seiki products.

Article 10. Support

  1. The notification, communication and support for the service shall be provided only in Japanese, English or Chinese to the Applicant Users and Registered Users.
  2. If the Applicant User or the Registered User wishes to contact or inquire about the service, the Inquiry page shall be used. Shima Seiki will not respond to contact and inquiries by other methods (including telephone calls and visits).

Article 11. Disclaimer and No Warranty

  1. Digital Contents are information for customers who have purchased Shima Seiki products, and are intended for use by customers who use Shima Seiki products. We may not be able to respond to inquiries or requests about Digital Contents from persons other than customers who have purchased Shima Seiki products.
  2. The Service does not necessarily provide Digital Contents for all products previously manufactured or sold in the past, or all products manufactured or sold in future, by Shima Seiki.
  3. Shima Seiki shall not be liable to any Registered User or any third party for any damage caused by such Registered User's use or failure to use the Service.
